Zephyr Kite & SUP Tours (ZKST) Terms and Conditions [as of dec 2011]

By paying your deposit we understand that you have read & accepted these ZKST travel terms and conditions.

Payments:
The fun house packages require a deposit of $500 per person within 7 days of confirmation to secure a booking paid directly to ZKST. The balance is due 60 days prior to departure. Bookings made within 60 days prior to departure, require full payment to be received within 7 days of the booking being confirmed. Once full payment has been received tour details will be emailed to your nominated address.
Prices quoted are subject to change until paid in full.

Changes to package:
Any changes to the package may incur an extra charge. Please check with ZKST before making extra arrangements or changes.

Flights:
Capped package prices for FUN HOUSE tours only - Purchasing your flights early will enable you to get cheaper seats. As the seats fill, the flights increase. If the cheapest possible fare exceeds $1288 (based on Virgin's flexi fare inc luggage Perth to Cocos return) for the exact dates of the tour, we will take off the difference of airfare from the package price.
Once you have booked onto a tour and booked your flights, by sending us your itinerary & tickets so can ensure you are booked in correctly and informed of any changes.

Cancellations:
ZSKT reserve the right to cancel a booking where payments have not been received by the due date & cancellation fees applied. ZSKT must be advised in writing of any cancellations by you or any member of your group.
The following charges will apply for cancellations of Fun house tours:

• From the date of deposit/balance being paid up to 3 months prior to departure – refund less $100 per person
• From the date of deposit/balance being paid within 3 months prior departure – refund less $500 (or no refund of deposit)
• Less than 60 days prior to departure – full deposit with held plus any charges incurred by the airlines, accommodation and ground operators amounting to all or part of the funds paid.
• After travel has commenced – no refunds paid.

ZKST reserves the right to cancel a tour due to insufficient numbers or any other reason. ZKST will endeavour to find an alternative tour if this occurs or your deposit/balance will be fully refunded.

Notes on packages:
The advertised shoulder season is for ZKST only and does not reflect any type of season or shoulder period on the Cocos Islands by accommodation providers or other tour operators. This is based on extending our kitesurfing season on Island only. Our shoulder season & extra on-demand packages will be based upon minimum bookings. Please check with us before committing to ensure it is going ahead.
Packages without flights must be booked with ZKST before booking your own flights. ZKST will not be held responsible for increased flight prices or changed flight times if the corresponding package has not been booked with ZKST first and under no circumstances will refunds be given if this occurs.
Booking your own flights for set date packages MUST be for those dates, otherwise standard accommodation rates apply for extra nights outside set date packages.
All accommodation is managed by private accommodation providers, all persons are bound to these accommodation providers’ terms & conditions.
Flights to & from Perth from your home town are not included & no packages include food, alcohol & non-kiting activities - except SUP is available for members on no-wind days.

General Conditions:
This is a holiday for kitesurfing, SUP, touring and relaxing. ZKST will endeavour to make this holiday a great one, however ZKST will not be responsible for any events that may occur that will disrupt the holiday. By paying your deposit, you will be accepting that the information given to you about the holiday/tour/destination is only a guide and if the holiday/tour does not live up to your expectations then ZKST will not be held responsible and at no time during or after the holiday will any refunds be given. It is your responsibly to assess the arrangements, location, conditions provided by us to agree to attend the ZKST Cocos Islands Kitesurfing and/or SUP Tour. It is also recommended that your own research is carried out prior to booking on the tour.
You will be responsible for your own actions whist on the Tour. All activities are undertaken at your own risk and you are aware of the inherent risks involved by undertaking any activities such as kitesurfing, Stand Up Paddle, driving/riding or being a passenger of any motor vehicle/bike or any other activity such as diving, surfing, snorkeling, fishing etc. We require that all participants comply with all directions and instructions provided to them by ZKST staff.  It is imperative for your own safety and the safety of others that all directions are complied with.  The tour operators will always be acting in your best interest and you must comply with their direction. If instructions are not adhered to or your actions cause issues among the other guests and create
an unsafe environment, ZKST has the right to cancel your membership, accommodation, transport and all inclusion activities. ZKST has the right to cancel membership and exclude members from any activity where he/she is unsafe or may put themselves or others in danger.
ZKST will not be held responsible for luggage/equipment being left behind. The air service to the Islands put food and medical supplies in the hold before sporting equipment. Should your kite/surf/boards be left behind for the next available flight, ZKST will endeavor to supply the best replacement kitesurfing equipment for you and the conditions until your personal equipment arrives on the Island. Any individual driving the ZKT vehicles or any hire vehicles including bikes, mopeds & boats will be fully responsible and accountable for that vehicle in the event of an accident or illegal behavior. ZKST will inform the authorities if any client’s conduct breaches the law.

Health & Injuries:
We encourage all our clients to ensure they are medically fit for this trip.  We encourage you to consult your doctor to ensure that you have the appropriate level of fitness before completing your booking.  All abilities of kite surfer & SUP'er will be catered for however it is the patron's responsibility to ensure that they will be medically fit to undertake this activity.  If you suffer any illness or injury during the tour it is your responsibility to inform us at your earliest opportunity so that we may assist you and prevent a similar injury happening to other patrons. If you suffer any illness or injuries during the Tour, ZKST will attempt to arrange medical treatment or emergency evacuation services for you at your cost and contact your nominated emergency contact if necessary. ZKST will not be held responsible for any associated expenses or suffering in the event of an accident.  The operators of ZKST will exercise reasonable care and skill in an endeavour to provide the safest possible environment for participants.  There may be dangers that are unavoidable and out of the control of operators.  We emphasise it is imperative that all directions and instructions provided by ZKST and their employees be complied with.  It is for your own safety and the safety of others.
By accepting the conditions set out in this Terms and Conditions form for ZKST you agree to indemnify the operators and each of them in the following manners.  You indemnify and hold harmless the land owners, the operators, their respective employees, servants and agents, against any actions or claims which may be made by me or on my behalf for or by other parties for or in respect of or arising out of my death or any injury, loss or damage caused to me or my equipment whether caused by negligence, breach of contract or in any other manner whatsoever.  Kite surfing & SUP are exhilarating but may also be dangerous and participants attending this tour do so entirely at their own risk.

Kite & SUP Tours & the Cocos Islands:
The ZKST Cocos Islands Tour is based predominantly on share accommodation, ZKST will not be held responsible for individuals actions whist in the share accommodation, and it is the terms and conditions of attending the tour that you must comply with the house and Island rules and regulations. You are to be sensible in your actions and considerate of others on the tour and all others on Island at all times whilst on the ZKST kitesurfing & SUP Tours. ZKST also has the right to refuse services and cancel membership, accommodation & transport to unhygienic, rude or drunken people.

The Cocos (keeling) Island is and Australian Territory, therefore the same Australian laws apply to all that are on the islands. This extends to road rules.  While cars are hired by ZKST, all drivers of these vehicles must be licensed to drive.  All drivers must comply with the road rules of Australia and any road signs on the Cocos Islands.  All drivers will be held personally liable for any damage caused to persons or property.  ZKST accepts no responsibility or liability in the event of an accident causing damage to a participant or other member of the public or to their property or equipment.

ZKST Kite Beach Terms & conditions
Membership:  Membership is included in ZKST tour packages. Outside of package tours - membership can be pre-purchased or bought on island. Membership is only available in blocks & cannot be purchased day by day. Personal equipment cannot be stored in or near the ZKST tent if membership is not purchased nor can non-members use the shade, shelter or seating of ZKST or use any other facilities or services without payment to ZKST (this does not include non-kiting partners).
ZKST kite beach Facilities: The beach facilities are available to all ZKST members. Your Personal equipment can be stored in the beach shelter from day to day. ZKST will provide all care within the shelter but will not be responsible for loss or damage or your equipment at any time on tour.
Lessons & coaching: Lessons are available upon request. A signed assumption of risk form is to be sighted, explained and signed by you before any formal instruction commences.
Lessons paid for but not taken will not be refunded unless we deem the weather to be unsuitable for completion.
Equipment Hire:  Kites, boards, SUP's and accessories can be hired if available from ZKST by members and non-members. Prices can be viewed in the ZKST beach Shelter.
Damaged equipment: Any ZKST equipment used by members or non-members that is returned damaged or broken by incompetence or misuse is to be paid for by the user to the replacement or repaired value prior to departing the tour.
A security deposit may be required to use ZKST hire and demo equipment. This will be returned upon safe return of equipment.

Daily patrons & On-Island Members are bound by these Terms and Conditions to the extent that is applicable to them.
