By making a payment to Zephyr Kiteboarding Pty Ltd for any of our tours or activities, we (Zephyr Kiteboarding) understand that you and ALL parties on your booking have read in its entirety and accepted all the Terms & Conditions and Assumption of Risk, Exclusion of Liability, Warranties and Waiver that are outlined below (updated August 2022). Please pay particular attention to PAYMENTS, KITESURFING TOUR CANCELLATION POLICY, AND INSURANCE.
TERMS & CONDITIONS
PAYMENTS
The payment terms and conditions for services to Zephyr Tours are separated into different headings based on your booked service. Please look for the heading that relates to your booking.
Cocos Kitesurfing Tours:
- Cocos (K) Islands Kitesurfing Tours booked with an “Early-bird” discount (before 30th September) require a 25% deposit within 7 days of booking. A further 25% is due before 31st December, and the remaining balance must be paid in full by the 30th April the following year.
- All other tour bookings require a 50% deposit to be paid within 7 days of booking, with the full balance due by April 30th.
- For all tour bookings made after April 30th, full payment is required within 7 days of booking.
- A 7-day cooling-off period applies to all tour deposits received before April 30th. This period begins the day the tour deposit is paid to the Zephyr Tours account.
- No cooling-off period will apply to tours booked after April 30th.
- All tour pricing is subject to change until payment is made in full.
Western Australia Kitesurfing Tours:
- W.A. Kitesurfing Tours require a 50% deposit to be paid within 7 days of booking, with the full balance due 12 weeks before the tour start date.
- For all tour bookings made within 12 weeks of the tour start date, full payment is required within 7 days of booking.
- A 7-day cooling-off period applies to all tour deposits received at least 12 weeks prior to the tour start date. This period begins the day the tour deposit is paid to the Zephyr Tours account.
- No cooling-off period will apply to tours booked within 12 weeks of the tour start date.
- All tour pricing is subject to change until payment is made in full.
Kitesurfing Lessons & Advanced Coaching:
- All kitesurfing lessons and advanced coaching sessions booked with Zephyr Tours require full payment 2 days before the kitesurfing lesson is scheduled.
- If the weather conditions are unsuitable for the kitesurfing lesson, and a new day and time cannot be scheduled, a full refund will be provided.
- Refunds will not be issued to individuals who do not attend the booked and scheduled lesson.
Gift Certificates:
- All gift certificates must be paid in full within 7 days of purchase.
- No refunds are available on gift certificates, nor gift certificates that have been applied to a booking.
KITESURFING TOUR CANCELLATION POLICY
The following cancellation policy will strictly apply to all kitesurfing tour bookings.
Up to 12 weeks before the tour start date:
- A $1000 per person cancellation charge will apply.
- The tour can be transferred to a future Zephyr Tour scheduled within 12 months without incurring a cancellation charge.
- Zephyr Tours must be advised in writing of tour cancellation by the person responsible for making the booking.
Within 12 weeks of the tour start date or after the tour has commenced:
- No refund will be provided.
- The tour can not be transferred to a future Zephyr Tour.
Zephyr Tours reserves the right to cancel a booking where payments have not been received by the due date and a cancellation fee may apply.
If a tour is cancelled for which a gift certificate has been applied, no refund will be provided for the value of the gift certificate. However, the value of the gift certificate will be credited to use on a future Zephyr Tour.
TOUR CANCELLATIONS OR CHANGES MADE BY ZEPHYR TOURS
- Zephyr Tours reserves the right to cancel a tour due to insufficient guest or staffing numbers or other necessary reasons. Zephyr Tours will endeavour to find a suitable alternate tour, or, a full refund will be provided (less any fees or charges).
- Under no circumstances is Zephyr Tours responsible for any fees, charges, or loss of earnings incurred because of a tour cancelled by Zephyr Tours, such as flight changes, or accommodation cancellation fees.
GENERAL CONDITIONS
Zephyr Tours holidays, guided adventures, kitesurfing lessons, and other activities are for relaxing and learning new skills. Zephyr Tours will endeavour to make your holiday a great one, however, we will not be responsible for any events that may disrupt your holiday or experience. By paying your deposit, you will be accepting that the information given to you about the holiday/tour/destination is only a guide and if the holiday/tour/destination does not live up to your expectations, Zephyr Tours will not be held responsible, and at no time during or after the holiday will any refunds be given.
It is your responsibility to assess the arrangements, location, and conditions provided to you by Zephyr Tours, and it is recommended that you conduct your own research prior to booking the tour.
You are responsible for your actions while participating in any Zephyr Tour activity. All activities are undertaken at your own risk, and you are aware of the inherent risks involved.
Zephyr Tours requires that all participants comply with all directions and instructions provided to them by our staff or contractors and it is imperative for your own safety and the safety of others that all directions are complied with. Zephyr Tour operators, instructors, guides, and hosts will always act in your best interest, and you must comply with their directions. If instructions are not adhered to or your actions cause issues among the other guests and create an unsafe environment, Zephyr Tours has the right to cancel your inclusions in all Zephyr Tour activities and the use of Zephyr Tours facilities. Zephyr Tours has the right to exclude members from any activity with no refund if the person is unsafe or may put others in danger.
HEALTH & INJURIES
Zephyr Tours encourages all our participants to ensure they are medically fit for their Zephyr Tour activity. All participants are encouraged to consult a doctor to ensure that they have the appropriate fitness level before completing their booking, as it is the participants’ responsibility to ensure that they will be medically fit to undertake this activity. If an illness or injury is incurred during the tour, it is your responsibility to inform us at your earliest opportunity so that we may assist you and prevent a similar injury from happening to other participants. If you suffer any illness or injuries during the tour, Zephyr Tours will attempt to arrange medical treatment or emergency evacuation services at your cost and contact your nominated emergency contact if necessary.
